The Family and Medical Leave Act (FMLA), which has long been a source of litigation and confusion in the workplace, has undergone major changes for the first time in its 15-year history. On November 17, 2008, the U.S. Department of Labor (DOL) released revised FMLA regulations, detailed in more than 750 pages, clarifying FMLA rights and obligations for employers and employees.

The new regulations address employee rights to leave for family and medical reasons, as well as military family leave, under FMLA Amendments enacted earlier this year. Among other changes, the new rules, which take effect on January 16, 2009, revise FMLA leave forms and procedures and enhance the remedies employees may seek for FMLA violations.
