New Rules providing for the scheduling, adjourning and conduct of administrative hearings to consider retirement matters proposed

A new hearing procedure to consider appeals of administrative decisions involving retirement issues has been proposed. The change involves the repeal of the current provisions of 2 NYCRR 317 and the adoption new provisions.

The change is in response to the significant increase in the demand for hearings to review and redetermine an application for retirement allowance or other benefit provided by the RSSL. The Retirement System deems it necessary to promulgate “an updated uniform procedure to be followed for all such hearings.
